These Terms of Service ("Terms") govern your use of businesswhisperer.com (the "Site"), which is operated by Business Whisperer, the Austin, Texas consulting and executive coaching practice of Jerry Llewellyn ("Business Whisperer," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. The Site vs. Consulting Engagements
The Site provides general information about Business Whisperer's executive coaching, management consulting, leadership development, organizational culture, business performance, AI integration, and strategic recruitment services. Using the Site, reading its content, calling, emailing, or submitting a form does not create a consulting, coaching, or other client relationship.
Every engagement with Business Whisperer is governed by a separate written engagement agreement signed by both parties. If anything on the Site conflicts with a signed engagement agreement, the engagement agreement controls.
2. No Professional Advice
Articles, guides, checklists, examples, and other Site content are general business information. They are not individualized advice, and they are not legal, accounting, tax, financial, investment, human-resources compliance, or employment-law advice. Business Whisperer is not a law firm or a CPA firm. Before acting on any information from the Site, consider your own circumstances and consult qualified professionals where appropriate.
3. Engagement Options and Pricing
The Site describes engagement options (currently Gold, Platinum, and Diamond — Executive Partnership) with example pricing, session counts, and terms. That information is provided to help you understand how engagements are typically structured. It is not an offer that can be accepted by using the Site, and it may change at any time without notice. The scope, fees, payment schedule, term, travel and expense billing, cancellation terms, and all other conditions of an engagement are set only in the signed engagement agreement.
4. The 2:1 Payback Guarantee
The Site describes Business Whisperer's 2:1 Payback Guarantee. The Site's description is a summary for information only. Eligibility, how results are measured, timeframes, client responsibilities, and the remedy available under the guarantee are defined solely by the written terms of the guarantee in your signed engagement agreement. No guarantee applies to anyone who has not signed an engagement agreement that includes it.
5. Client Results and Testimonials
Client results, case examples, figures, and testimonials shown on the Site reflect the experiences of specific clients in specific circumstances. They are not typical or promised outcomes, and past results do not guarantee future results. Business outcomes depend on many factors outside our control, including market conditions, your team, your decisions, and how consistently recommendations are carried out.
6. Consultation Requests and Communications
When you submit a consultation request or other form on the Site, you agree that the information you provide is accurate and that you are authorized to share it. Form submissions are delivered to our customer relationship management system (Zoho CRM) so that we can respond to you. By providing your email address or phone number, you agree that Business Whisperer may contact you by email, phone, or text message about your inquiry. You may ask us to stop contacting you at any time; message and data rates may apply to text messages.
Please do not send trade secrets, confidential financial records, or other sensitive information through Site forms or unsolicited email. Information shared before an engagement agreement is in place is not subject to any confidentiality obligation beyond what is described in our Privacy Policy. How we collect and use personal information is described in the Privacy Policy, which is part of these Terms.
7. The Master Plan and Other Downloads
The Master Plan and any other materials offered for download are licensed to you, not sold. You may use them for your own internal business planning and share them within your own organization. You may not resell, republish, rebrand, or distribute them publicly, or use them to provide paid consulting or training to others, without our written permission.
8. Intellectual Property
The Site and its content — including text, articles, graphics, logos, photographs, page designs, and downloadable materials — are owned by Business Whisperer or Jerry Llewellyn, or used with permission, and are protected by copyright, trademark, and other laws. "Business Whisperer," "MicroFlow," "the Business Whisperer Method," and related names and logos are trademarks of Business Whisperer. Except for the limited rights described in these Terms, no license to our intellectual property is granted. You may view and print Site pages for personal, non-commercial reference, and you may quote short excerpts with attribution and a link to the source page.
9. Acceptable Use
When using the Site, you agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms.
- Submit false or misleading information, or another person's information, through Site forms.
- Send spam, malware, or unsolicited promotional material through Site forms or contact details.
- Attempt to gain unauthorized access to the Site, its hosting, or connected systems, or interfere with their security or operation.
- Copy, scrape, or republish substantial portions of Site content, or use it to build a competing product or service, without our written permission.
- Imply that Business Whisperer or Jerry Llewellyn endorses you, your business, or your products without our written permission.
10. Third-Party Links and Services
The Site links to or embeds third-party services, such as Google Maps, and uses third-party providers to host the Site and process form submissions. We do not control those services and are not responsible for their content, availability, or practices. Your use of a third-party service is governed by that provider's own terms and privacy policy.
11. Disclaimer of Warranties
The Site and all of its content are provided "as is" and "as available." To the fullest extent permitted by law, Business Whisperer disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that its content is complete or current.
12. Limitation of Liability
To the fullest extent permitted by law, Business Whisperer, Jerry Llewellyn, and their affiliates, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to your use of, or inability to use, the Site or your reliance on its content, even if advised of the possibility of such damages. Our total liability for any claim arising from your use of the Site will not exceed one hundred U.S. dollars ($100). This section does not limit any obligation stated in a signed engagement agreement, which is governed by that agreement's own terms.
13. Indemnification
You agree to indemnify and hold harmless Business Whisperer and Jerry Llewellyn from any claims, losses, liabilities, and expenses, including reasonable attorneys' fees, arising from your violation of these Terms or your misuse of the Site.
14. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to the jurisdiction of those courts.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "last updated" date at the top of this page. Your continued use of the Site after an update means you accept the revised Terms.
16. General Provisions
If any provision of these Terms is found unenforceable, the remaining provisions will stay in effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and Business Whisperer about your use of the Site; they do not replace or modify any signed engagement agreement.
